1. Who provides PacePilot

PacePilot ("the app", "we", "us") is operated by Paul Olyslager, a sole trader established in Germany. Registered address: Goethestr. 29a, 13086 Berlin, Germany. Contact: contact@pacepilot.cc.

PacePilot is an AI-assisted training application that analyses your cycling data and generates personalised training plans. The in-app coach ("Elena") provides informational guidance based on established sport-science principles.

2. What PacePilot is not

PacePilot is not a medical service and does not provide medical, physiotherapy, psychological, or dietetic advice. Elena is not a doctor, physiotherapist, psychologist, or dietitian; she is instructed to decline questions in those areas and to direct you to a qualified professional. Training plans, recovery guidance, and any wellbeing or nutrition suggestions are informational and motivational only.

Consult a qualified medical professional before starting any new training programme, and for any pain, injury, illness, persistent low mood, disordered-eating concern, or symptom that feels wrong. Do not disregard or delay professional medical advice because of anything in the app. You are responsible for your own training decisions.

3. Eligibility

You must be at least 16 years old to use PacePilot. Your date of birth is collected at signup and an account cannot be created below this age. [Age threshold — 16 vs 18 for individualised training-load guidance — to be confirmed with counsel.]

4. Your account

You agree to provide accurate information and to keep your login credentials secure. You may delete your account at any time from Profile → Account. Deletion cancels any active subscription and permanently erases your personal data, except for records we are legally required to keep (see the Privacy Policy, §6).

5. Subscription, billing and cancellation

Free trial: 14 days, with no payment details required.
Paid subscription: after the trial, continued use of the coaching features requires a paid subscription — €16.99 per month or €169 per year. These are final prices: as a small business under § 19 UStG, no VAT is charged. The exact amount and currency are shown before you confirm.
Payment: billing is handled by PayPal. We are the merchant of record. By subscribing you authorise a recurring billing agreement with PayPal that renews on your chosen cadence until you cancel.
Cancellation: you can cancel at any time from within the app. Cancelling stops future renewals and ends the billing agreement; access continues until the end of the period you have paid for.
EU right of withdrawal: as a consumer in the EU you have a statutory right of withdrawal for the paid subscription. How this applies to a digital service that begins immediately after a free trial, and any refund policy, are set out at checkout. [Withdrawal and refund terms — to be confirmed with counsel.]

6. Acceptable use

Do not misuse the AI (including prompt-injection, scraping, or reselling its outputs), attempt to access other users' data, or use automated means to abuse the service.

7. Liability

Cycling and structured training carry inherent risks, including injury. You acknowledge these risks and remain responsible for your own training decisions and for how you apply the app's guidance.

To the extent permitted by applicable German law, our liability for slight negligence is limited in matters that do not involve injury to life, body or health. We do not exclude or limit our liability for injury to life, body or health, for intent or gross negligence, or where liability is mandatory under law (including under the German Product Liability Act). [Precise limitation wording is being finalised with counsel under BGB §309 Nr. 7 — a US-style "assumption of risk" waiver does not apply here.]

8. Data and integrations

See the Privacy Policy for how your data is collected, used, and shared with sub-processors (Supabase, Anthropic, Vercel, PayPal, Whoop, intervals.icu).

9. Changes to these terms

We may update these terms. Material changes are notified in the app and require your re-acceptance before continued use.

10. Governing law

These terms are governed by the law of Germany. This does not deprive you of the protection of mandatory consumer-protection rules of your country of residence in the EU. [Governing law / competent court — to be confirmed with counsel.]
